Queue member receive second call ringinuse=no

I am detecting a problem were calls are ringing to an agent already busy on a call while realtime queue ringinuse is set to no

Did you verify the device state of the device involved on this issue ?

My understanding it should be in a busy state because of the first call that was received.

What services could cause the device state to change while its busy on a call?

If using chan sip callcounter must be set to yes

Yes, callcounter is set to yes:

Which asterisk version you are using?

Connected to Asterisk 13.24.1 currently running

I am busy testing 13.28.1 at another client, but didn’t see any thing in the changelog to indicate that it will fix the problem.

Upgraded to 13.28.1 and still experiencing the same issue:
